Shoei saves my noggin'

Bit of a weird one this

I'm riding to work 3 days ago, filtering up the bus lane, scaffold lorry is blocking it ( obviously ) I go around it and BLAM! I get whacked on the head.

The young man, first day on the job has lost control of an 8m steel ladder and has dropped it right on my head as i pass the truck.
I manage not to fall off and am rather dizzy for 10 to 15 mins. Some apologies from the scaffolders and i'm on my way.

Later, with a splitting headache i realise my helmet is probably stuffed and its done its job saving my life. If i'd been a cyclist with no helmet, it might have been a very different story.

Anyway, i see them the next morning, but they seem very uninterested in discussing insurance / paying for my lid. What a surprise.

I've bought a new lid, not worth the risk of using the other one, but i'm really not sure if its going to be worth chasing payment from the scaffolders.

Any thoughts?

Deffo claim....

and inform the H&S Exec - it's important you do.. could have been a small child, not your well protected head.

Then,, like Feck says, contact the office and tell them you want your lid replaced. If they refuse, go for the full hit against their insurance, it'll cost them much more in the long run. But then again, the H&S should give them plenty of grief.

Personally, I'd get checked out by a doctor too, especially as you were dizzy for a while.

I appreciate these guys have to work, but they have to do it safely (insofar as the public are concerned), if they weren't interested after then this is an good indication of the attitude they have to the public. You need to have them investigated - imagine if the same thing happens next week to a toddler ? and you could have done something ?

Email HSE with full details, copy/scan of lid receipt, photos, full description, as much details as you can come up with. CC scaffold company, also Association for Project Safety, County Police HQ, your insurance company, and Insurance Ombudsman. I think the 'Organ Grinder' would be happy to cough up a few for a new lid to avoid investigation by the above.....

Definitely tell your Dr. just in case.

If your have any recurrent headaches you may need to be able to link it back to this incident.

Tell the H&S rep you have reported the injury to your Dr.

Plenty of claim compensation companies out there - I hate the blame/claim culture but it sounds like you have a legitimate claim.

I work in a very similair sector and public liability is an important factor for exactly this reason, accidents happen! If you want progress on this one just go to the top of the food chain, pretty useless talking to the poor saps on 8 an hour, they know nothing nor do they care. Count your lucky stars u r ok and take a visit to ur gp for a check up. Glad u still able to talk to us about it mate! Ahoy.
